Anatomy of a DUI Traffic Stop

A routine traffic stop is a regular procedure for many police officers, however, is can be one of the most dangerous weapons in their arsenal. First, it is important to keep in mind that while lawfully a police officer must have probable cause to pull over a vehicle, it does not necessarily mean that they need a large reason. There are a lot of nuances that they could utilize – some details such as a dirty license plate, unrepaired body damage or even windows that are tinted too dark could all give a police officer valid reason to pull you over.

Once they have initiated the traffic stop, the driver will approach you on your passenger side. They will request pertinent documents such as the driver's license, the vehicle registration and proof of insurance. If they decide that there is reason to suspect that you are driving under the influence, they might request that you step outside of your vehicle to participate in DUI testing. This could be field sobriety tests or could be blowing into a breathalyzer.

If these tests further confirm their belief that you are impaired, they will place you under arrest and will transport you to the police station in their vehicle to undergo further testing. You will then most likely be asked to submit to a chemical test, such as the urine, breath or blood test. If your blood alcohol concentration (BAC) is over the legal limit, you will then be formally charged and will enter into both the civil and criminal proceedings.
