Habitual Drunk Driver Kills Passenger

Jennifer Fram, now 25 years old, was arrested after killing her boyfriend in a drunk driving accident on April 21, 2012 in Mobile, Alabama. With a blood alcohol level of .16%, twice the legal limit in Alabama, she lost control of the car and sent her boyfriend, Nick Markow, flying from the vehicle during the crash. At the time of the accident, Fram was already on probation for a previous DUI conviction. Her license had been revoked, so she was not supposed to be behind the wheel in the first place.

According to her arrest history in Mobile, Alabama, she had been booked for several DUI charges before killing her boyfriend as a result of her latest DUI offense. She could be classified a habitual drunk driver, as she was booked for two previous DUIs in 2011, in January and November. The reason she was not being held in jail for these previous offenses is because Alabama law only mandates 48 hours of consecutive imprisonment or 20 days of mandatory community service for a second DUI conviction. A third DUI would result in 60 days in jail, but for a DUI to be considered a felony, it must be the fourth consecutive DUI offense within a 5 year time frame.

District Attorney Ashley Rich states, "The one thing that I think we've done wrong within the state is, we only count DUIs from the previous five years to go toward enhancement purposes. I think that you're entire criminal history should be a part of any enhancement statutes for DUI penalties." If this were the case, penalties could be waged much more severely upon repeat offenders.
