Man Charged with Reckless Driving After Speeding at 170 MPH

A young motorcyclist, Nikkolaus McCarthy, was clocked speeding at 170 MPH on a public road on May 3, 2012 in New York. He has since pleaded guilty to a misdemeanor charge of reckless driving—which was lessened from the original felony speeding charge. He was sentenced by a judge to "time already served" in jail, which was the equivalent of 20 days in McCarthy's case, as well as the suspension of his license for a minimum of one year.

McCarthy didn't seem to be phased upon hearing how fast he was found to be going by the New York State Police, stating after his release, "I'm feeling good! I'm going home! You'll see me on the race track." It seems that police feel lucky to have even caught McCarthy in the first place. Assistant District Attorney, Jasper Mills, explained, "He ran out of gas. That's what stopped him. I mean the police here, once you get up to a certain rate of speed, just for the purposes of public safety and other people out on the road, they're not going to pursue a person at that rate of speed." Although McCarthy was posing a threat to all other driver's out on the road, had the police decided to pursue him, they would have been posing the same exact danger.

The consequences could have been fatal for McCarthy had he been involved in an accident while reaching speeds of 170 MPH. Reckless driving not only endangers the driver, but also anyone else around them, so penalties are heavily placed upon anyone posing a threat on the road. If you are facing reckless driving charges, it is imperative to enlist the help of a knowledgeable attorney. In the case that you should be convicted of a reckless driving charge, the consequences could be jail time. At Thomas & Paulk, a qualified attorney can provide you with the chance to avoid the penalties of a conviction.
