Underage DUI Fatality

On May 24, 2012, Maria Ana Anguiano, 41, and her daughter, Desiree Anguiano, 20, were arrested in lieu of an underage drinking fatality. On January 22, 2012, Desiree hosted a birthday party at her family's home in Riverside County, which provided alcohol to all of the underage attendants. Maria Ana Anguiano knowingly let her daughter and her friends partake in underage drinking, including one young woman, Ashly Nicole Rodriguez, 19. After becoming intoxicated at the party, Rodriguez decided to leave. She got behind the wheel with her friend, Aaron Ellison, 19, in the passenger seat of her car.

While driving near Lake Skinner, Rodriguez lost control of the car and crashed. Ellison was then thrown from the passenger seat of the vehicle, and sustained injuries that proved to be fatal. Rodriguez pleaded guilty to vehicular manslaughter while intoxicated on May 14, 2012, and is expected to face up to 12 years in prison after she attends her sentencing hearing on June 28, 2012.

As far as Maria Ana and Desiree Anguiano, they are both being charged with misdemeanor charges for their role in Ellison's death. They are both liable for the fatal DUI that occurred, because they are both responsible for providing alcohol to underage drivers at the party. District Attorney Paul Zellerbach sates, "Adults, who should be the ones setting the proper example for the minors, also need to know and consider the consequences [of underage drinking]. They can, and will be whenever possible, prosecuted for supplying alcohol to someone underage."

Underage DUIs, and consequently, DUI fatalities, have been on the rise in recent years, and the consequences of such are beginning to be taken much more seriously. As was the case for Maria Ana and Desiree Anguiano, even providing alcohol to underage drivers is grounds for prosecution, so if you are facing similar charges, do not hesitate to enlist qualified legal assistance immediately. At Thomas & Paulk, P.A., we can assist you in any of your DUI legal matters.
