California Crime Lab Discovers Inaccurate Blood Alcohol Tests in Almost 2,200 Cases

According the Los Angeles Times, 2,200 DUI cases involved incorrect blood alcohol tests at the Orange County Crime Lab. While this might only change dozens of DUI charges, nine hundred people received letters notifying them that their DUI conviction included an inaccurate blood alcohol test. This problem had gone unnoticed for almost five months. An audit found that human error accounted for an incorrectly calibrated instrument on one of its machines. These blood sample tests were skewed by 0.003 percentage points. That may not seem like a big deal, but in some cases it could change the outcome.

There are around 200 cases where the blood alcohol content would change by 0.01, which is significant for borderline test results. In fact, twenty people would see their BAC change to 0.07 percent, which would place them below the legal standard for impairment. While this is far from guaranteeing that these charges will be dismissed, this could substantially alter those cases. Even if the charges are not dropped, sentencing could be reduced.
