Fort Myers Mother Charged with DUI in Rollover Accident

Last Monday in Lee County, a mother appeared in court for a DUI charge which she had received the day before after a rollover crash; her children were also in the Jeep at the time. According to deputies, the mother swerved as she was changing lanes, leading to a crash. No injuries were reported. Police said they found empty wine bottles in her front seat and that they could smell alcohol on her. The 45-year-old faces charges of DUI and property damage, DUI with blood alcohol content at 0.15 or higher, and refusal to submit to a DUI test. She is being held on bond, must wear an alcohol monitoring bracelet, and cannot so much as possess alcohol. She will also have to submit to random drug and alcohol testing.

Regardless of whether or not this woman has prior convictions, these charges are already enough to carry the potential of severe sentences. For instance, whether or not someone is actually intoxicated, if they refuse a blood or breath test, then they could have their driver's license suspended because of implied consent law. If a defense lawyer cannot argue that a BAC was much lower than 0.15, which is nearly twice the legal limit, then this could easily entail a lengthier sentence for imprisonment. And since children were in the car, this could easily be viewed as an aggravating factor.

Of course, no DUI charge is a simple matter. Highly technical, these charges also carry life-changing sentences. If you or someone you know has been charged, then you need to find experienced legal help immediately. A DUI conviction could cloud your reputation for the rest of your life, getting in the way of any housing, work, or loan application, and even a few days' delay could mean losing your driver's license for months, severely inhibiting your mobility and independence.
