DUI Cases & the Florida Point System

Florida, along with many other states, assign a number of points to certain traffic violations that you may commit. These points add up within a certain amount of time, and when too many are have been accrued, your driver's license may be suspended. Points are acquired from the date that the offense occurs, and vary depending on the severity of the violation.

How does a DUI affect the point system?

The number of points garnered within a specific point results in different sentencing. In Florida, this looks like:

  • 30-day suspension for 12 points within 12 months
  • 3-month suspension for 18 points within 18 months
  • 12-month suspension for 24 points within 36 months

While these points seem like a lot, there are a number of high-scoring points that can contribute. For example, speeding less than 15 miles above the speed limit, any moving violation, an improper lane change, and littering all carry three points. If you obtained all 4 of these in any 12 month period, you would be eligible for your license to be suspended.

Gathering a number of points on your license can also lead to insurance increases of up to 50%. While some points can be removed by attending a traffic school, this does not apply to all cases. Aside from the risk of losing your license, you may also face significant increases in the amount of money you will be paying to insurance companies as a result.

Points for a DUI

However, those charged with a DUI do not get any points added to their license. This is due to the fact that there are a number of immediate and harsh penalties associated with this crime, such as time behind bars, an automatic licenses suspension, and a number of other charges and fines. If you have been accused of DUI under Florida law, you do not have to worry about potential points added to your license. The penalties enacted as a result of a DUI conviction accomplish the goals of the point system anyway, which is to punish drivers on the road.

When you have been accused of driving under the influence, you need to ensure that your rights are protected. Our firm can help defend you against charges leveled against you and start getting your driving privileges back.
