At DUI Arrest, Florida Man Tells Officer He Had to "Drive Off" a Couple of Drinks

Reported in an article Friday, March 7, it was discovered that a Florida man made remarkably unhelpful statements during a DUI arrest last month. According to the police report, a 61-year-old man was stopped for speeding on the highway. As the officer approached the man's car, he said that he smelled alcohol coming out of the vehicle, and that when the driver spoke, his words slurred into one another. That was probable cause enough for the cop to ask the driver to perform field sobriety tests, tests which he failed. His blood test results also came up with a blood alcohol content of 0.104 and 0.103.

The driver also failed to use his right to remain silent, and is said to have blurted out some incriminating information. The 61-year-old is reported to have said that he had some drinks and was driving to a bar to drink some more. He unfortunately volunteered that he had argued with his wife, who had said he had had too many drinks. He simply wanted to "drive it off", as he told the officer.

As the police report can figure largely into the case, it is only too likely that this unadvised speech has given a prosecutor the ammunition to present a strong case to convict this man of a DUI. This means that he could be faced with:

  • Six months in jail
  • Fines of up to $250-$1,000
  • Driver's license suspension for up to 1 year
  • Probation for up to 1 year
  • And more

These penalties could also include community service hours and vehicle impoundment. On top of these serious penalties for a first-time DUI, a conviction would mean being saddled with a criminal record. This is a stain to one's reputation that is visible to the public eye, including during a job interview, or a house or loan application.
