Conditions for Release of Persons Arrested for DUI - s. 316.193 (9), F.S.
After a Tampa DUI arrest, there are specific conditions which must be met in order for a person to be released from custody. These include the following:
- The driver is no longer under the influence of alcohol/drugs;
- The driver's mental and physical abilities are back to normal;
- The driver's blood alcohol or breath alcohol level is now below .05%; or
- At least eight hours have elapsed from the time of arrest.
