Florida High School Coach Arrested for DUI

Friday, June 6, a baseball coach at Riverview High School was arrested on suspicion of driving under the influence. The arrest came shortly before midnight. He refused to perform field sobriety tests, and he was taken to Hillsborough County jail. He was released the next day on $500 bond. There were no details given on any chemical DUI tests, such as a breath or blood test. The suspect has been on the high school's coaching staff for nine years, the athletic director did not offer any comment on the arrest.

It is important to note that despite the story these sparse details seem to convey: you can refuse a field sobriety test without penalty. Sure, this refusal is likely to increase an officer's suspicion, but implied consent only involves breath or blood tests.

What Implied Consent Really Means for Florida Drivers

According to Florida's implied consent law, if you have a driver's license, you have already agreed to take any chemical DUI tests that a police officer asks you to take if you are legally arrested on suspicion of DUI. If you refuse a breath or blood test, your driver's license would be suspended for 12 to 18 months—even if you are not proven guilty of DUI after that point. None of this applies to field sobriety test refusal. The results or refusal of a field sobriety test could be used by a prosecutor, however. But any DUI arrest will result in the confiscation of your driver's license, which is why one of your first steps in your case is to schedule a DHSMV hearing to save your license if you can.

When you face the loss of your driving privileges, your reputation, your job, and your freedom, you need to ensure that you find the best Tampa DUI defense you can. Contact Thomas & P.A. to find out how our Tampa DUI lawyers may be able to fight for you!
