NHL Player Ryan Malone Pleads No Contest to DUI Charge

A former hockey player for the Tampa Bay Lightning has plead no contest to DUI charges. On April 12, Ryan Malone was arrested in Tampa after weaving down a street in a 2014 Chevrolet Suburban. Malone was pulled over and asked to perform a field sobriety test, which he refused. The arresting officer searched Malone and discovered 1.3 grams of cocaine in his back pocket. The legal limit to drive in the state of Florida is 0.08 and Malone had a blood alcohol level of 0.112.

What is a No Contest Plea?

Malone plead no contest to DUI charges. A no contest plea differs from a guilty plea, as it means the charge is accepted without admittance of guilt. The plea can then no longer be used as evidence in a civil or criminal proceeding stemming from the case. A no contest plea is generally used to get lesser consequences, such as in a plea bargain.

The former NHL player will enter a pretrial intervention program on the cocaine possession charge. If the program is completed, the felony drug charge will be dismissed. He also was sentenced to a 12 month probation, 6 month suspension of his driver's license, DUI School, and 50 hours of community service.

The penalties for a first time DUI offense in Florida can carry months of jail time, thousands of dollars in fines, a license suspension, and can require the installation of an ignition interlock device. These increase with the number of DUIs a person has.
